Terms of service
Last updated October 21, 2026
1. Who we are
Fairwood Delivery ("we", "us") is a small, locally owned delivery service based in Fairwood, an unincorporated area of King County, Washington. These terms apply when you use fairwooddelivery.com or place an order with us. By placing an order you agree to them. If you don't agree, please don't order.
2. What we do
- We deliver food from our partner restaurants to addresses inside our Fairwood delivery area. The site checks your address before you pay; we can't deliver outside the area.
- We deliver only during the hours shown on the site, and only while the site says we are taking orders. You can also order ahead for a time inside those hours.
- The restaurant prepares your food. We are not the restaurant and don't cook or package it.
- We don't deliver alcohol, tobacco, cannabis or anything other than restaurant food and drinks.
3. Prices and payment
- Food: the restaurant's regular in-store menu prices. We don't mark them up. Restaurant deals are applied automatically and shown before you pay.
- Delivery fee: a flat $5.00 per order.
- Tip: optional, and 100% goes to your driver.
- Tax: if sales tax applies to your order it is shown before you pay. If none is shown, none is charged.
- The total shown next to the Pay button is exactly what you are charged. Prices come from our system, never from your browser, so if a price changes while you're checking out we'll show you the new total first.
- Payment is by card through Stripe, a payment company. Your card details go straight to Stripe; we never see or store them. Your order is placed once Stripe confirms the payment.
4. Your order
- Please give a correct address, a phone number we can reach you on, and any notes we need (gate codes, apartment number, where to leave it).
- Delivery times are estimates. Restaurants get busy and things happen; we'll keep you posted by email and on your order page.
- If we can't reach you at the door, we'll call or text. If we still can't reach you after about 10 minutes, we'll leave the order at your door if it's safe to, and it's then your responsibility.
- A restaurant may run out of an item or be unable to make an order. If that happens we'll contact you, and if we cancel, you're refunded in full (see Refunds & cancellations).
- We may refuse or cancel an order if the address is outside the area, the payment looks fraudulent, the weather or roads make delivery unsafe, or someone has been abusive to a driver or restaurant. If we cancel a paid order you get a full refund.
5. Food safety and allergies
Restaurants prepare and package your food and are responsible for what's in it. We keep food closed, upright and delivered promptly, and we never open your bags. If you have a food allergy, add a note to the item and, for serious allergies, call the restaurant before ordering: we can pass a note along but can't guarantee a kitchen is free of an allergen.
6. Accounts
You don't need an account to order. If you make one, you sign in with a code we email you, so keep your email secure. You can delete your account at any time from the Account page.
7. Fair use
Please don't misuse the site: no fake orders, no attempts to break into it or overload it, and no harassment of drivers or restaurant staff.
8. If something goes wrong
Tell us first and we'll try to put it right; most problems are solved with a refund or a redelivery. Our responsibility for an order is limited to the amount you paid for it, as far as the law allows. Nothing in these terms takes away rights you have under Washington law, including the Washington Consumer Protection Act. We're not responsible for delays caused by things outside our control, such as weather, road closures or a restaurant's own delays.
9. Law and disputes
These terms are governed by the laws of the State of Washington. If we can't sort out a problem together, it will be handled by the courts in King County, Washington, unless the law gives you the right to bring it somewhere else.
10. Changes
We may update these terms. The date at the top shows the latest version, and the version in place when you ordered applies to that order.
